Do I Have A Good Case?

The truth is that at the outset no one can promise you that you have a good case. If they do, get it in writing.

Every case is different. Even though every case is different—car accidents, personal injury, wrongful death, defective products, etc.—all cases have three elements: damages, fault, and coverage. Damages are the amount of harm the responsible party caused. Fault is the responsible party’s degree of fault. And coverage is the amount of insurance or financial resources to compensate for damages that the responsible party caused.

Because we work on a contingency fee basis—which means that we do not get paid unless you get compensated—we only handle cases that we believe we can successfully resolve. Initially, we examine the interplay between damages, fault, and coverage to make an educated guess whether a case is economically viable.

An economically viable case is like a recipe. There must be fault, damages, and adequate coverage. If there are a lot of damages but no fault, the case is not economically viable. If there is a lot of fault but no damages, the case is not economically viable. If there is no coverage, usually, the case is not economically viable regardless of the degree of damages and level of fault.

Remember, as your case develops and the facts are determined and revealed, what was once a bad case can become a good case, and vice versa. Your recovery is always limited by the amount of coverage, regardless of the degree of damages or level of fault. You cannot squeeze water from a rock.
